By browsing, accessing, or placing sample and product inquiry requests on nuform.com ("Site"), you agree to be legally bound by these Terms & Conditions ("Terms"). If you do not accept these terms, you must refrain from using our Site.
You represent and warrant that you possess the legal authority to bind the corporate entity on whose behalf you are accessing our Site and placing B2B packaging requests.
Using our website signifies your acceptance of these binding commercial and operational terms.
Acceptable Website Use
Prohibited actions and security rules
The Site is intended exclusively for legitimate B2B packaging procurement, product catalog review, technical specification inquiry, and trade communications.
The following activities are strictly prohibited:
- Scraping & Data Mining: Automated harvesting, scraping, crawling, or extracting of product images, specifications, or CAD drawings without explicit written approval.
- Malicious Security Tampering: Attempting to bypass security controls, introduce viruses, execute SQL injections, or breach server infrastructure.
- Misrepresentation: Submitting false corporate inquiries, fraudulent identity details, or impersonating competitor brands.
Unauthorized scraping, security breaches, or false representations will result in access revocation and legal recourse.
Product Specifications & Usage Disclaimers
Thermal thresholds, material standards, and buyer testing responsibilities
NuForm Packaging manufactures high-clarity rigid packaging using 100% virgin Polyethylene Terephthalate (PET, Resin Code 1) adhering to BRCGS Food Safety and CPCB guidelines.
Buyers and end-users must observe the following physical operating parameters:
- Temperature Thresholds: Standard PET containers operate effectively within -20°C (freezer storage) to +60°C (+140°F). Packaging is NOT microwave-safe or suitable for hot oven filling above 60°C.
- Compatibility Testing: While our PET resin is 100% food-safe, buyers are responsible for performing shelf-life, oil/acid reactivity, and stacking load tests with their specific food contents prior to commercial distribution.
- Dimensional Tolerances: Molded thermoformed containers are subject to standard manufacturing tolerances of ±1.5% in weight, volume, and linear dimensions.
- Lid Seal Integrity: Liquid-tight performance requires proper snap-engagement of designated NuForm V-notch or U-notch precision lids.
PET containers operate between -20°C and +60°C and are NOT microwaveable. Buyers must verify product compatibility for specific food formulations.
Quotations, MOQs & Custom Logo Mold Embossing
Commercial terms for orders, custom tooling, and artwork approvals
All quotations issued by NuForm Packaging are valid for 30 calendar days from the date of issue unless specified otherwise in writing.
Custom embossed molds and bespoke color swatch formulations are subject to specific commercial terms:
- Minimum Order Quantities (MOQs): Standard catalog items require baseline order quantities. Custom embossed containers require specific volume commitments outlined in contract quotes.
- Custom Tooling Ownership: Buyers paying dedicated custom mold tooling fees retain non-exclusive rights to the unique embossed graphic design. Physical tooling remains stored and maintained at our Morbi plant for exclusive production of buyer orders.
- Artwork & Logo Authorization: Buyers guarantee that any logo, brand artwork, or trademark submitted for custom engraving is fully owned by buyer or licensed without infringing third-party IP rights.
Custom logo embossing requires artwork ownership warranties and adherence to agreed tooling volume commitments.
Limitation of Liability & Warranty Caps
Financial liability boundaries and warranty remedies
NuForm Packaging warrants that delivered PET packaging meets agreed product specifications and BRCGS food safety standards upon dispatch from our Morbi plant.
To the maximum extent permitted by applicable law:
- Warranty Remedy: In the event of defective or non-conforming packaging batches, NuForm Packaging’s sole liability is limited to either replacing the non-conforming items or refunding the invoice price of the defective units.
- Indirect Damages Disclaimer: NuForm Packaging shall NOT be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of food contents, lost profits, business interruption, or brand reputation claims.
- Notice of Defect: Claims regarding batch defects or freight damage must be submitted in writing with batch codes within 14 calendar days of shipment delivery.
Our maximum legal liability is capped strictly at the purchase invoice value of defective packaging units.
Intellectual Property Rights
Ownership of brand assets, website media, CAD molds, and design specs
All content, vector graphics, product imagery, CAD mold profiles, technical descriptions, trademarks, and logos displayed on this Site are the exclusive intellectual property of NuForm Packaging / Lyka Polymers.
No portion of this Site may be reproduced, modified, distributed, republished, or incorporated into external media without prior express written authorization from NuForm Packaging.
All website imagery, CAD designs, logo icons, and technical content are protected trademark and copyright assets.
Governing Law & Jurisdiction
Applicable legal jurisdiction for disputes
These Terms & Conditions, and any disputes or claims arising out of or in connection with site usage or commercial transactions with NuForm Packaging, shall be governed by and construed in accordance with the laws of India.
The courts located in Morbi / Rajkot, Gujarat, India shall have exclusive jurisdiction over any legal proceedings arising hereunder.
All legal disputes are governed under Indian law with exclusive jurisdiction in courts of Morbi/Rajkot, Gujarat.
